ACCEPTANCE OF TERMS

The materials that Formatta provides to you are subject to the following Terms of Use ("TOU"). Formatta reserves the right to update the TOU at any time without notice. The current version of the TOU can be reviewed by clicking on the "Terms of Use" hypertext link located at the bottom of each web page.

DESCRIPTION OF MATERIALS

Through its website, Formatta provides you with access to a variety of resources, including form design software, form filler software, download areas (including, but not limited to, sample electronic forms), product information and documentation generally (collectively "Materials"). The Materials, including any updates, enhancements and new features, are subject to the TOU.

USE OF SOFTWARE AVAILABLE ON THIS WEB SITE

Any software that is made available to download from the Formatta website ("Software") is the copyrighted work of Formatta and/or its suppliers. Use of the Software is governed by the terms and conditions of the end user license agreement accompanying or included with the Software ("License Agreement"). An end user must first agree to the License Agreement terms before installing and/or using any Software that is subject to a License Agreement.

The Software is made available for download solely for use by end users subject to the terms and conditions of the License Agreement included with the Software. Software expressly identified as available for download for evaluation purposes only is subject to further restrictions regarding length of evaluation period and limitations on use and distribution. Any unauthorized reproduction or redistribution of the Software is expressly prohibited by law, and may result in severe civil and criminal penalties. Violators will be prosecuted.

COPYING, REPRODUCING, PUBLISHING, OR IN GENERAL DISTRIBUTING THE SOFTWARE TO ANY OTHER WEBSITE OR SERVER OR LOCATION FOR FURTHER DISTRIBUTION, COPYING, REPRODUCING OR PUBLISHING IS EXPRESSLY PROHIBITED, EXCEPT AS EXPRESSLY PERMITTED IN THE LICENSE AGREEMENT ACCOMPANYING SUCH SOFTWARE.

ANY SOFTWARE AVAILABLE ON THE FORMATTA WEBSITE IS WARRANTED ONLY ACCORDING TO THE TERMS OF THE LICENSE AGREEMENT ACCOMPANYING SUCH SOFTWARE. EXCEPT AS WARRANTED IN THE LICENSE AGREEMENT, FORMATTA CORPORATION DISCLAIMS ALL WARRANTIES WITH REGARD TO THE SOFTWARE, INCLUDING ALL WARRANTIES OF MERCHANTABILITY (WHETHER EXPRESS OR IMPLIED) AND FITNESS FOR A PARTICULAR PURPOSE.

FORMATTA MAY MAKE AVAILABLE AS PART OF THE MATERIALS, OR IN ITS SOFTWARE PRODUCTS, FORMS FOR USE AND/OR DOWNLOAD. FORMATTA DOES NOT MAKE ANY ASSURANCES WITH REGARD TO THE ACCURACY OF THE RESULTS OR OUTPUT FROM THE USE OF ANY SUCH FORMS.

GOVERNMENT LICENSEE

If you are acquiring the Materials on behalf of the United States Government, the following provisions apply: The Government acknowledges Formatta Corporation's representation that the Materials were developed at private expense and no part of them is in public domain. The Materials are "Commercial Items," as that term is defined at 48 C.F.R. 2.101, consisting of "Commercial Computer Software" and "Commercial Computer Software Documentation," as such terms are used in 48 C.F.R. 12.212 or 48 C.F.R. 227.7202, as applicable. Consistent with 48 C.F.R. 12.212 or 48 C.F.R. 227.7202-1 through 227.7202-4, as applicable, the Materials (Commercial Computer Software and Commercial Computer Software Documentation) are being licensed to U.S. Government end users (A) only as Commercial Items and (B) with only those rights as are granted to all other end users pursuant to the terms and conditions herein.

USE OF DOCUMENTS AVAILABLE ON THIS WEB SITE

Permission to use Documents (such as press releases, white papers and FAQs) from the Materials is granted, provided that (1) the Formatta copyright notice appears in all copies, and (2) the Documents are not modified.

THE DOCUMENTS, INCLUDING GRAPHICAL DEPICTIONS OF PRODUCT SYSTEMS, FUNCTIONS, AND OPERATIONS, MAY CONTAIN TYPOGRAPHICAL ERRORS, OMISSIONS AND/OR INACCURACIES. THE DOCUMENTS MAY BE UPDATED AT ANY TIME, EITHER TO CORRECT ERRORS, OMISSIONS AND/OR INACCURACIES, OR TO REFLECT CHANGES IN THE PRODUCTS OR SERVICES TO WHICH THE DOCUMENTS PERTAIN.

LIMITATION ON USE

Unless otherwise specified, the Materials are for your personal and/or commercial use, subject to the restrictions in this TOU. You may not modify, publish, license, create derivative works from, or sell any information, software, products or services obtained from the Materials, except as specifically provided for in the License Agreement for any Formatta product(s).

LIMITATION ON LIABILITY

The Materials are being provided from the Formatta website AS IS, and Formatta makes no warranty as to their use or performance. FORMATTA AND ITS SUPPLIERS DO NOT AND CANNOT WARRANT THE PERFORMANCE OR RESULTS YOU MAY OBTAIN BY USING THE MATERIALS. FORMATTA AND ITS SUPPLIERS MAKE NO WARRANTIES, EXPRESS OR IMPLIED, AS TO NONINFRINGEMENT OF THIRD-PARTY RIGHTS, MERCHANTABILITY, OR FITNESS FOR ANY PARTICULAR PURPOSE. IN NO EVENT WILL FORMATTA OR ITS SUPPLIERS BE LIABLE TO YOU FOR ANY CONSEQUENTIAL, INCIDENTAL, OR SPECIAL DAMAGES, INCLUDING ANY LOST PROFITS OR LOST SAVINGS, EVEN IF A FORMATTA REPRESENTATIVE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, OR FOR ANY CLAIM BY ANY THIRD PARTY.

NO UNLAWFUL OR PROHIBITED USE

As a condition of your use of the Materials, you agree not to use the Materials for any purpose that is unlawful or prohibited by terms of this TOU, or by the terms of the License Agreement for any Software.
